There is no type of organization we know of called a "commercial HOA". Some opponents to the formation of a managment district have been spreading this mis-information. Perhaps what they are implying is that the district would not have the authority that "commercial property owner associations" have where they exist. Those associations exist where there are planned communities and essentially create the same effect as zoning.

Let's consider how a commercial owners association is created and could it be created to include all the commercial properties.

A commercial property owners association is similar to a home owners association in that each commercial property was originally sold with deed restrictions like are in many residential, pre-planned neighborhoods where many of us live.Those developements were concieved and restrictions established as part of the future deeds before the properties were sold. We boiught them knowing the restrictions were in place. 

The commercial property owners in the FM1960 area bought the properties without deed restrictions. Not even the legisature has the authority to impose deed restictions on them and no one we know has the money to pay them to assume such restrictions--whatever they might be.

No other existing management district was created with deed restrictions being added to all commercial properties and neither will the one proposed for the FM1960 area. Management Districts DO NOT restrict how commercial or residential property is used. Management districts do not create zoning which is what the opponents perhaps support.
